1. About this policy
This Privacy Policy explains how [Map Alerts Pty Ltd] (ABN 73695414718) ("Map Alerts", "we", "us", "our") handles personal information. It applies to our website, our platform, data feeds, APIs and related services (the "Service").
We are committed to protecting personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs").
2. The kinds of personal information we collect
We keep the personal information we collect to a minimum. The personal information we may collect and hold includes:
(a) Account and contact information – such as the name, business name, email address, phone number, and role of the individuals who set up or manage a customer account;
(b) Billing information – we send you the invoice so we do not collect any billing information details from you apart from what is shown in the bank statements on receipt of payment.
(c) Support and communications – information contained in emails or messages you send us, and our responses;
(d) Technical and usage information – basic server logs and records of how the Service is accessed and used (such as IP address, API request logs, and timestamps), which we use to operate, secure and troubleshoot the Service; and
(e) Messaging group information – where the Service delivers alerts into a messaging group (such as a Telegram group), we may have visibility of limited information about the members of that group, such as their messaging-platform username or display name, and in some cases a phone number, depending on each member's own privacy settings on that platform. Many members' details are not visible to us where they have set their accounts to private. We handle this information only to the extent necessary to operate and deliver the Service.
3. Incident data is not personal information
3.1. The incident data collected and delivered through the Service consists of non-identifying information such as coordinates and timestamps. It does not include names, contact details, device identifiers, usernames, vehicle details, or other information from which an individual is reasonably identifiable.
3.2. Accordingly, we do not treat the incident data (the "Alert Data") as personal information, and this Privacy Policy is principally concerned with the business-account, billing, support and technical information described in clause 2.
3.3. If our collection practices change such that the incident data could identify an individual, we will update this policy and our handling practices accordingly.
3A. Messaging platforms and third-party maps
3A.1. The Service may deliver alerts by posting a link into a messaging group (such as a Telegram group). The messaging platform is operated by a third party, is generally based or hosts data outside Australia, and handles information about its users in accordance with its own terms and privacy policy. We encourage you and your group members to review the messaging platform's privacy policy.
3A.2. We may be able to see limited information about members of a group (such as a username or display name), depending on each member's own privacy settings. We do not control those settings and we do not use that information for any purpose other than operating and delivering the Service.
3A.3. Where alerts are delivered as a link to a public third-party map (such as Waze or Google Maps), the incident is viewed on that third party's own public service. Those services are operated by the relevant third parties and are subject to their own terms and privacy practices. We do not control them.
3A.4. If you create or administer a messaging group to receive alerts, you are responsible for the members you add and for ensuring they are aware that alerts will be delivered into that group.
4. How we collect personal information
4.1. We collect most personal information directly from you — for example, when you create an account, communicate with us, or use the Service.
4.2. We may also collect technical information automatically when you access the Service (such as server and API logs).
4.3. Where it is reasonable and practicable, we collect personal information directly from the individual concerned. If you provide us with personal information about another person (for example, a colleague you add to your account), you must ensure you are authorised to do so and that they are aware of this policy.
5. Why we collect, hold and use personal information
We collect, hold and use personal information to:
(a) set up, administer and manage customer accounts;
(b) provide, maintain, secure and improve the Service;
(c) invoice and process payments, and manage our business records;
(d) respond to enquiries and provide support;
(e) communicate with you about the Service, including service or billing notices and changes to our terms; and
(f) comply with our legal obligations.
We do not sell personal information. We do not use personal information for third-party advertising.
6. Cookies and website tracking
6.1. Our website does not use analytics or tracking cookies.
6.2. We may use a small number of strictly necessary cookies or similar technologies where required for the website or Service to function, or that our third party hosting sets up to use their service.
7. Disclosure of personal information
7.1. We may disclose personal information to:
(a) service providers and platforms who help us operate our business and deliver the Service — for example, cloud storage and document services (such as Google Drive), the messaging platform we deliver alerts through (such as Telegram), hosting, and (once engaged) payment and email providers — who are authorised to use the information only to provide services to us or to operate their own platform under their own terms;
(b) professional advisers such as our lawyers or accountants, where reasonably necessary;
(c) a purchaser or potential purchaser of our business, in connection with a sale or restructure; and
(d) government, regulators or law enforcement, where required or authorised by law.
7.2. We do not otherwise disclose your personal information without your consent, unless required or permitted by law.
8. Overseas disclosure
8.1. Some of our service providers and the third-party platforms we use — including cloud and document-storage providers such as Google, and the messaging platform Telegram — may store or process data on servers located outside Australia (for example, in the United States or other countries where those providers operate). The third-party map services we link to (such as Waze and Google Maps) are also operated outside Australia.
8.2. Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure it is handled in a manner consistent with the APPs.
9. Security of personal information
9.1. We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure — including access controls, secure credentials, and limiting access to information to those who need it.
9.2. No method of transmission or storage is completely secure. While we work to protect personal information, we cannot guarantee absolute security.
9.3. We retain personal information only for as long as needed for the purposes described in this policy or as required by law, and take reasonable steps to destroy or de-identify it when it is no longer needed.
10. Accessing and correcting your personal information
10.1. You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.
10.2. To make a request, contact us using the details in clause 12. We will respond within a reasonable period. We may need to verify your identity first. If we decline a request, we will tell you why, where we are required to.

11.1. If you have a concern or complaint about how we have handled your personal information, please contact us using the details in clause 12. We will acknowledge your complaint and aim to resolve it within a reasonable time.
